The Eighth Circuit affirmed the district court's denial in part of the University's motion to dismiss an action alleging violations of Title IX of the Education Amendments of 1972. The district court refused to dismiss the Title IX claims on the basis of sovereign immunity. Students granted deferred removal action by the United States Department of Homeland Security (DHS) under its Deferred Action for Childhood Arrivals (DACA) policy are not eligible for in-state college tuition in Arizona.In 2013, the Arizona Attorney General filed this action seeking a determination that the Maricopa County Community College District Board’s (MCCCD) policy of accepting employment authorization documents (EADs) issued to DACA recipients by the DHS as evidence of residency for students to receive in-state tuition violated Arizona law. The Attorney General also sought an injunction prohibiting MCCCD from allowing DACA recipients to obtain the in-state tuition rates. Two DACA-recipient MCCCD students who receive in-state tuition intervened. The trial court granted summary judgment to MCCCD and the students, concluding that DACA recipients are “lawfully present” for purposes of eligibility for in-state tuition and are therefore eligible for in-state tuition benefits. The Supreme Court disagreed, holding that DACA recipients are not “lawfully present” for purposes of 8 U.S.C. 1623(a), which governs in-state tuition benefits, and therefore, DACA recipients are not eligible for in-state tuition. Parents of Z.B. filed suit alleging that DCPS failed to offer Z.B. a fourth grade education appropriate to her needs under the Individuals with Disabilities Education Act. The DC Circuit affirmed the district court's holding that DCPS complied with the IDEA in offering Z.B. the 2015 individualized education program (IEP), but remanded for the determination as to whether it did so when it offered her the 2014 IEP. In this case, it remained unclear whether and how DCPS itself made a valid assessment of Z.B.'s needs before it offered the 2014 IEP—and so whether that IEP was adequate. The court explained that the issue was whether each of the IEPs that was proffered was adequate at the time, not that it was the parents' burden to show that any possible placement in DCPS was not a viable option or would not have worked. The circuit court violated the requirements of W.Va. Code 62-12-11 by imposing a second five-year probationary period upon Petitioner.Petitioner was convicted of petit larceny and received a five-year probationary period. The initial probation period commenced on March 24, 2011. On February 10, 2016, approximately one month before Petitioner’s five-year probation period was set to expire, the State filed a motion to revoke probation, contending that Petitioner had failed to make his required restitution payments. Petitioner admitted to the violation. The circuit court subsequently revoked Petitioner’s probation by order dated March 16, 2016 and imposed a second five-year probation period. Petitioner argued that the circuit court had violated section 62-12-11 by extending his probation beyond the original five-year period. The Supreme Court agreed, holding that the restrictions of section 62-12-11 prohibited the circuit court from imposing a second five-year probationary period. View "State v. Cookman" on Justia Law

The court of appeals properly vacated the temporary injunctions granted by the district court forestalling the Commissioner of Education’s revocation of two open-enrollment charter schools’ charters and dismissed the schools’ suit seeking judicial review of the Commissioner’s revocation on the grounds that sovereign immunity barred the schools’ claims.In their petitions for judicial review, the two open-enrollment schools challenged the validity of the Commissioner’s decision to revoke their respective charters, raising both constitutional and ultra vires complaints. The district court issued two orders temporarily enjoining the Commissioner from proceeding with the revocations. The court of appeals vacated the temporary injunctions and dismissed the schools’ underlying claims, concluding that all claims were barred by sovereign immunity. The Supreme Court affirmed, holding that the enabling statutes precluded judicial review of the Commissioner’s executive decisions at issue here, and no basis otherwise existed to invoke the district court’s inherent authority. After Jerald Glaviano interceded in a confrontation between two of his students, the Sacramento City Unified School District (the District) placed him on unpaid leave and issued an accusation and a notice of intent to dismiss or suspend him without pay. The Commission on Professional Competence (Commission) dismissed the accusation and ordered the District to reinstate Glaviano to his former position with back pay and benefits. Education Code section 449441 provided that if the Commission determines an employee should not be dismissed or suspended, the governing board of the school district shall pay “reasonable attorney’s fees incurred by the employee.” Glaviano requested fees based on the prevailing hourly rate for similar work in the community, but the trial court concluded the fee award must be based on the reduced hourly rate Glaviano’s counsel actually charged. The issue presented on appeal was whether the phrase “reasonable attorney’s fees incurred by the employee” in section 44944 necessarily limited a fee award to fees actually charged. The Court of Appeal concluded it did not. The Court found the lodestar method appropriate: reasonable hours spent, multiplied by the prevailing hourly rate for similar work in the community. Dr. Susan Kegerise sought reinstatement as superintendent of the Susquehanna Township School District, as well as back pay and benefits. In January 2010, Kegerise was appointed superintendent. In 2013, the District’s Board of Directors extended Kegerise’s contract for a three-year term after agreeing, at Kegerise’s request, to include a resignation provision in her employment contract. Kegerise alleged this resignation clause was necessary to protect her interests in light of several Board members’ inappropriate behavior. Kegerise further alleged that, this clause notwithstanding, and in an effort to force her resignation, several Board members persisted in hostile actions including, inter alia, physical intimidation and verbal abuse, even after the contract was executed. In 2014, Kegerise informed the Board that she was receiving medical care and would be unable to return to work until April 21, 2014. While Kegerise was on medical leave, the Board received several letters from Kegerise’s counsel asserting that Kegerise had been constructively discharged. The Board responded by affirming that Kegerise remained the Superintendent of Schools, and that “[h]er time away from the District since that day has been recorded as sick leave derived from Dr. Kegerise’s pre-existing sick leave accumulation.” On April 17, 2014, Kegerise filed a complaint at the United States District Court, alleging, inter alia, that the Board had constructively discharged her. Kegerise asserted that, “although no formal termination has taken place, [she] cannot perform the job duties of Superintendent,” due to the Board’s behavior toward her. Kegerise sought damages in excess of six million dollars, including compensatory and economic damages “for loss of contractual salary and other emoluments of employment” and consequential damages for “damage to professional reputation and loss of future salary as an educational administrator.” The trial court held an evidentiary hearing to determine whether Kegerise had intended to resign when she filed her federal complaint, after which, it ordered the Board to reinstate Kegerise to her position with back pay and benefits. The Board appealed to the Commonwealth Court; the Commonwealth Court affirmed the trial court’s grant of mandamus. The Pennsylvania Supreme Court, however, found Kegerise did not demonstrate to a clear legal right to reinstatement. Wisconsin law gives state university students rights to organize themselves and to run their governments, which have the power to spend substantial funds. Plaintiffs, the University of Wisconsin Madison (UWM) Student Association and former and current UWM students, alleged a conspiracy to interfere with student governance in violation of various rights protected by 42 U.S.C. 1983. They claim that the UWM administration excluded certain students from student government by unseating the legitimately elected officers and replacing them over several years with a supposedly “puppet” student government with a similar name, the defendant Student Association at UWM. The district court dismissed the suit with prejudice. The Seventh Circuit affirmed the dismissal of the claims against the defendants who were not timely served with process and the dismissal of a right-to-organize claim under state law. The court reversed the dismissal with prejudice of the remaining claims for misjoinder, stating that it could understand the district court’s frustration, but the remedy for misjoinder is severance or dismissal without prejudice. Plaintiffs, five students who attend public schools in the city of Boston, failed to state a claim for relief in their complaint alleging that the charter school cap under Mass. Gen. Laws ch. 71, 89(i) violates the education clause and the equal protection provisions of the Massachusetts Constitution because Plaintiffs were not able to attend public charter schools of their choosing.Plaintiffs sued the Secretary of Education, the chair and members of the board of secondary and elementary education, and the Commissioner of Education seeking declaratory and injunctive relief. Defendants filed a motion to dismiss. The motion judge granted the motion, concluding that Plaintiffs failed to state a claim under either the education clause or the equal protection provisions of the Massachusetts Declaration of Rights. The Supreme Judicial Court affirmed, holding (1) Plaintiffs failed to allege facts suggesting not only that they had been deprived of an adequate education but that Defendants failed to fulfill their constitutionally prescribed duty to educate; and (2) there was no plausible set of facts that Plaintiffs could prove to support a conclusion that the charter school cap did not have a rational basis. Within the 2006 through 2010 tax years, the Oklahoma Tax Commission and the Oklahoma State Board of Equalization issued certified assessments of certain public property physically located within the boundaries of the Stroud school district. Ad valorem taxes associated with these properties were distributed by the Lincoln County Treasurer to the Cushing and Wellston districts, instead of to Stroud. The error was discovered and subsequently corrected by the Lincoln County Board of Tax Roll Corrections during the 2010-2011 fiscal year. There was no disagreement among the three school districts that they were not responsible for the errors made in the distribution of the ad valorem taxes. To recover the funds that should have been Stroud's, Stroud sued Cushing and Wellston school districts. Stroud filed its petition on April 22, 2013. The defendant school districts filed a motion for summary judgment in December of 2014. In the same month, the plaintiff responded with its own motion for summary judgment. Stroud received the taxes from the property identified as within its district; Cushing received the taxes from the property identified as within its district; and Wellston received the taxes from the property identified as within its district. The Oklahoma Supreme Court found Stroud received the same amount for its general funds that it would have received had the ad valorem taxes been properly allocated. Nevertheless, it demanded additional funds from Cushing and Wellston that it would have received if the real property had been correctly identified. The Court determined if that amount was paid to Stroud, then Cushing and Wellston would have deficits in those districts that they would not have if the real property had been correctly identified. Stroud did not believe the other two school districts are entitled to a setoff if they paid Stroud the misallocated ad valorem taxes. The Court found all three school districts were victims of this error, but no district failed to receive the funds needed for their respective districts. The Court reversed judgments against the Cushing and Wellston districts and that in favor of Stroud: "county and state officials will make mistakes in the taxing of property and the distribution of taxes."
