M.C. filed suit under the Individuals with Disabilities Education Act (IDEA), 20 U.S.C. 1400(d)(1)(A), alleging that the district violated the IDEA by (1) failing to adequately document the services provided by a teacher of the visually impaired (TVI), (2) failing to specify the assistive technology (AT) devices provided, and (3) failing to file a response to the due process complaint. The court concluded that the district's failure to adequately document the TVI services and AT devices offered to M.C. violated the IDEA and denied M.C. a free appropriate public education (FAPE); these procedural violations deprived M.C.'s mother of her right to participate in the individualized education program (IEP) process and made it impossible for her to enforce the IEP and evaluate whether the services M.C. received were adequate; and, at the very least, plaintiffs were entitled to have the district draft a proper IEP and receive compensatory education he would have occupied but for the school's violations of the IDEA. In 2010, plaintiff (age 15) was playing floor hockey with 11 other students in his physical education class when a “squishy” ball bounced off his stick and hit him in the eye, causing permanent injury to his eye. Plaintiff alleged that Cunningham, the instructor, was willful and wanton in failing to require the students to wear protective eyewear. Goggles were available, but plaintiff testified that he probably would not have worn them, had he been aware that they were an option. Cunningham testified that she thought the use of plastic sticks and squishy balls negated the need for goggles and that there were safety rules in place. Defendants asserted affirmative defenses alleging statutory immunity under the Local Governmental and Governmental Employees Tort Immunity Act, 745 ILCS 10/2-201, 3-108. The trial court directed a verdict for defendants. The appellate court reversed. The Illinois Supreme Court reversed, reinstating the directed verdict. There was no evidence that defendants were aware of facts which would have put a reasonable person on notice of the risk of serious harm from the activity, which would have triggered the “willful and wanton” exception to the Act. The Individuals with Disabilities Education Act (IDEA) offers states federal funds to provide every eligible child a “free appropriate public education” (FAPE), by means of an “individualized education program” (IEP). 20 U.S.C. 1401(9)(D), 1412(a)(1), “reasonably calculated to enable the child to receive educational benefits.” For children fully integrated in the regular classroom, this typically requires an IEP “reasonably calculated to enable the child to achieve passing marks and advance from grade to grade.” Endrew, who has autism, received annual IEPs. By fourth grade, Endrew’s parents believed his academic and functional progress had stalled and enrolled him in a specialized private school, where he made significant progress. School district representatives later presented a new fifth grade IEP, but the parents considered it no better than the original plan. They sought reimbursement for tuition. The Colorado Department of Education denied the claim. The district court and Tenth Circuit affirmed. The Supreme Court vacated. A school must offer an IEP reasonably calculated to enable a child to make progress appropriate in light of the child’s circumstances. Focus on the particular child is the core of the IDEA. Precedent does not provide concrete guidance concerning a child who is not fully integrated in the regular classroom and not able to achieve on grade level. A child’s IEP need not aim for grade-level advancement if that is not a reasonable prospect, but every child should have the chance to meet challenging objectives. This standard is more demanding than the “merely more than de minimis” test applied by the Tenth Circuit. The Court declined to hold that the Act requires states to provide educational opportunities that are “substantially equal to the opportunities afforded children without disabilities.” The adequacy of an IEP turns on the unique circumstances of the child for whom it was created. Delaware State University hired Dr. Grevious as an associate professor and as a department chairperson in August 2010, with a contract to end in June 2011. Grevious complained that her supervising administrators were impeding her work on reaccreditation based on her gender. In 2011, the University gave Grevious a renewable contract as an associate professor for the 2011- 2012 academic year. Grevious was unable to meet the reaccreditation deadline. The University terminated her term as chairperson. Grevious filed an EEOC charge of discrimination; the investigation was closed for lack of corroborating evidence. The University revoked Grevious’s renewable contract and issued her a terminal contract ending her employment effective May 2012. Grevious claims that the Provost admitted that this was based on the EEOC charge, unrelated to her teaching or professional performance. She filed a second EEOC charge. The Provost denied making such admissions, stating that the decision was based on Grevious’s documented interpersonal conflicts at the University. Grevious sued, alleging retaliation under Title VII, 42 U.S.C. 2000e-3, and retaliation under 42 U.S.C. 1981. The district court rejected her claims on summary judgment. The Third Circuit reversed with respect to her contract revision claim, but otherwise affirmed, holding that at the prima facie stage, a plaintiff need only proffer evidence sufficient to raise the inference that her engagement in a protected activity was the likely reason for the adverse employment action, not the but-for reason. AHA and Isaiah Smith filed suit against the school district, alleging that the school district's policy of inviting students to deliver statements, which can include invocations, before school-board meetings violated the First Amendment's Establishment Clause. The district court granted summary judgment for the school district. The court agreed with the district court that a school board was more like a legislature than a school classroom or event where the board is a deliberative body, charged with overseeing the district's public schools and other tasks. In Town of Greece v. Galloway, the Supreme Court stated unequivocally that the legislative-prayer exception in Marsh v. Chambers extends to prayers delivered at town-board meetings. In this case, the court concluded that the school board was no less a deliberative legislative body than was the town board in Galloway. Accordingly, the court affirmed the summary judgment in No. 16-11220, and reversed the order denying summary judgment in No. 15-11067. View "American Humanist Assoc. v. Andrew Hugine, Jr., Ph.D., Daniel Wims, Ph.D., and Mattie Thomas, Ph.D., petitioned the Alabama Supreme Court for a writ of mandamus directing the Circuit Court to vacate its order that denied their requests for qualified immunity and State-agent immunity from all claims filed against them in their individual capacities by Regina Colston in an action stemming from the termination of Colston's employment at Alabama Agricultural and Mechanical University ("the University") and to enter a summary judgment in their favor. Colston was hired as an instructor at the University to teach telecommunications for the School of Arts and Sciences in the Department of English, Foreign Languages, and Telecommunications. She taught broadcast journalism and other similar classes at the University continuously for the next 32 years. It was undisputed that the University was facing budget problems when Hugine was hired as president in 2009. The University evaluated faculty for potential dismissal. In the case of Colston, the University found that she was not tenured, and she was placed on the list recommending dismissal. Colston filed a grievance upon being fired. Colson filed suit, and the trial court entered a summary judgment in favor of the defendant as to all claims by Colston seeking compensatory and/or punitive damages against any defendant in the defendant's official capacity. The trial court denied summary judgment as to all other claims. Subsequently, Hugine, Wims, and Thomas filed the present petition for a writ of mandamus in which they asked the Supreme Court to vacate the trial court's judgment. After review, the Supreme Court determined that the trial court erred in not holding that Wims and Hugine were entitled to qualified immunity from Colston's retaliation claims based on alleged violations of her free speech and free-association rights. The Court likewise concluded that Hugine, Wims, and Thomas were entitled to State-agent immunity with respect to Colston's state-law claims against them individually alleging wrongful termination, fraud, and tortious interference with a contractual relationship. In 2009, Dr. Burton was hired as a professor at the University of Wisconsin‐Platteville. She was promoted to associate professor. Burton subsequently received a complaint from a student who claimed that another professor had sexually harassed her. Burton contacted Dean Throop, and her department chair, Caywood. The offending professor claimed the incident was designed to display to the class social norms by violating them. Days later, Caywood circulated a memo, stating professors were to bring students’ complaints directly to Caywood, rather than going outside of the department. Caywood believed Burton had overreacted. Throop and Caywood then began to withdraw support for a curriculum that Burton was developing. Burton was unanimously granted tenure. Caywood stepped down as department chair. Burton filed a charge of discrimination with the Wisconsin Department of Workforce Development, alleging discrimination based on her sex and retaliation for reporting the student incident and deliberate indifference to her grievances. Administrators pressured her to drop her case. Burton filed suit and contacted the EEOC. Days later, Throop sent Burton a letter identifying seven examples of inappropriate behavior by Burton. After Throop accused Burton of canceling class without permission, Burton sent an email asking all of her students for their help in proving that she had held class that day. The Seventh Circuit affirmed rejection of Burton's claims on summary judgment. "Burton’s frustrations may be significant," but do not amount to actionable retaliation under Title VII or Title IX. Jacob has Attention Deficit Hyperactivity Disorder and Disruptive Mood Dysregulation Disorder and requires an Individualized Education Plan. He repeated kindergarten in a general education classroom with additional support. Jacob’s second year of kindergarten included several behavioral disturbances. His parents disagreed with recommendations to change his placement and services and filed a due process complaint, 20 U.S.C. 1415(b). After additional testing, the parents and their psychologist with the District. Some of Jacob’s services were discontinued and a Behavioral Intervention Plan was adopted. The District recommended that Jacob be placed in the Social Emotional Learning Foundations program (SELF). Jacob’s parents objected and SELF-placement was not adopted. Jacob struggled with the new Plan, The District sought to place Jacob in SELF, in a different district, over his parents’ objections. Jacob’s parents believed that SELF was more restrictive than necessary and that he should remain in general education in his home district. The Act maintains the placement status quo until the complaint is resolved, so Jacob was never moved to SELF. The district court affirmed an administrative decision, concluding that the District met the Act’s substantive requirement of providing Jacob with a free appropriate public education. The Seventh Circuit vacated, reasoning that the matter is moot because Jacob is in third grade and the parties have reached agreement regarding his third-grade placement. View "Ostby v. Plaintiff Gerald Castille worked as a school bus driver for the St. Martin Parish School Board. During his first few years, plaintiff drove two "undesirable" routes, as they "required the assigned bus driver to travel very long distances while trying to maintain a safe and orderly bus populated with children from families that were known to have little or no respect for the bus operators. . . ." In 1980, plaintiff was assigned to the "Highway 31 Route," which was initially considered undesirable, plaintiff asserted it changed over time and became more desirable as the route became less populated. While driving that route for nearly thirty years, plaintiff claimed to have developed relationships with the students and their parents, noting the route gave him "a sense of purpose and dignity." In the spring of 2008, the costs of diesel fuel began to rise, and the School Board was forced to take steps to save money by redrawing and reassigning bus routes. Prior to the start of the 2008-2009 school year, the bus drivers received their new route assignments. The School Board assigned plaintiff a combined "Levee-Portage Route," two of his old routes, with no change in his salary, health benefits, or retirement. Plaintiff objected to this new route, but claimed the bus manager told him to try the route for a few weeks and come back if he was still unhappy. After two weeks, plaintiff requested to be returned to the Highway 31 route, but was told to deal with the current situation. He alerted his supervisors to the problems, but claim they took no action. According to plaintiff, he began experiencing anxiety and depression problems during this time. His problems continued until 2011, when a more desirable vacant route became available. Plaintiff filed the instant suit against the School Board, alleging the School Board violated La. R.S. 17:493.14 in assigning the bus routes in 2008. The Supreme Court granted certiorari in this matter to consider whether the court of appeal erred in awarding plaintiff damages for bad faith breach of contract. The Court found the court of appeal erred in awarding bad faith damages and therefore reversed that portion of the court of appeal's judgment, and affirmed in all other respects. View "Castille v. Petitioner Kadle Properties Revocable Realty Trust (Trust), challenged the dismissal of the Trust’s appeal to the New Hampshire Board of Tax and Land Appeals (BTLA), filed after respondent, the City of Keene (City), denied the Trust’s application for an educational use tax exemption. The Trust owned property in Keene that included an office building. A separate, for-profit corporation, Config Systems, Incorporated (Config Systems), rented a portion of the Trust’s office building, where it offered computer classes. The Trust did not own or operate Config Systems, but Daniel Kadle, in addition to serving as trustee for the Trust, was a beneficiary of the Trust and the sole shareholder of Config Systems. The Trust sought the exemption based upon Config Systems’s use of part of the property as a school. The Trust appealed the City’s denial of its request to the BTLA. During the BTLA hearing on the Trust’s appeal, the City moved to dismiss the appeal. The BTLA granted the City’s motion, reasoning that the property owner, the Trust, was not a school, and that Config Systems, the entity operating the school which the Trust claims qualified the property for an exemption, did not own the property.
