Kendrick v. The Advertiser Company
Kevin Kendrick, as director of compliance at Alabama State University (ASU), appealed the grant of summary judgment ordering him to provide The Advertiser Company d/b/a The Montgomery Advertiser ("the Advertiser") with redacted copies of each "request for reduction/cancellation of athletic financial aid" form submitted to the director involving the ASU football program since December 15, 2014. A reporter for the Advertiser initially sent a written request for the forms to the school's media relations director spoke. The media relations director to the reporter by telephone, advising the reporter that because the forms contained sensitive personal student information, the forms would be heavily redacted. The reporter emailed the media relations director stating that he would "take just the list of names of players whose scholarships have been revoked since December [2014]." Later that day, the media relations director, under advice of university counsel, informed the reporter he could not even provide a list of names, citing privacy concerns under the Family Educational Rights and Privacy Act of 1974 (FERPA). Legal counsel for the Advertiser and legal counsel for ASU exchanged correspondence regarding whether the financial aid forms were subject to disclosure. When the parties could not agree, the Advertiser filed a declaratory judgment suit and petition for a writ of mandamus to compel the records' disclosure. The Supreme Court, after review, reversed and remanded the grant of summary judgment: "We commend the trial court for its efforts to comply with both FERPA and the Open Records Act by requiring ASU to redact the requested financial-aid forms in the manner it directed. However, the release of the redacted financial-aid forms to the Advertiser would nonetheless disclose information that is protected by FERPA, and the Advertiser did not argue that the release of the redacted financial-aid forms is authorized by any other exception in FERPA. Because FERPA prohibits the very release of the redacted financial-aid forms and because FERPA takes precedence over the Open Records Act, the director is entitled to a summary judgment." Harris v. Stampolis
Harris is the principal at Peterson Middle School in the Santa Clara Unified School District. Stampolis, a district board member, has a son who attends Peterson. In October 2014, Harris obtained a civil harassment restraining order (Code Civ. Proc., 527.6) against Stampolis after he became aggressive toward her when she confronted him about how he was regularly late to pick up his son after school. The court of appeal affirmed, finding that sufficient evidence supported conclusions that Stampolis made a credible threat of violence toward Harris on August 27, 2014; that it is reasonably probable that unlawful harassment may occur in the future absent a restraining order; and that the harassment caused Harris emotional distress. Fisher v. Univ. of Tex. at Austin
The University of Texas at Austin’s undergraduate admissions system offers admission to all students who graduate in the top 10% of their Texas high school class, as required by the Texas Top Ten Percent Law. It fills the remainder of its freshman class, about 25%, by combining an applicant’s “Academic Index” (SAT score and high school academic performance) with a “Personal Achievement Index,” a holistic review containing numerous factors, including race. The University adopted the system in 2004, after a year-long-study of its admissions process—undertaken following two Supreme Court decisions—led it to conclude that its prior race-neutral system did not reach its goal of providing the educational benefits of diversity. Fisher was denied admission to the 2008 freshman class. She alleged that the University’s consideration of race disadvantaged her and other Caucasian applicants, in violation of the Equal Protection Clause. On remand for application of the strict scrutiny standard, the Fifth Circuit again affirmed summary judgment in the University’s favor. The Supreme Court affirmed. The race-conscious admissions program is lawful under the Equal Protection Clause. The compelling interest that justifies consideration of race in college admissions is not an interest in enrolling a certain number of minority students, but an interest in obtaining “the educational benefits that flow from student body diversity.” The University articulated concrete and precise goals—e.g., ending stereotypes, promoting “cross-racial understanding,” preparing students for “an increasingly diverse workforce and society,” and cultivating leaders with “legitimacy in the eyes of the citizenry” and gave a “reasoned, principled explanation” for its decision. The University’s conclusion that race-neutral programs had not achieved its diversity goals was supported by significant statistical and anecdotal evidence, while consideration of race has had a meaningful, but limited, effect on freshman class diversity. That race consciousness played a role in a small portion of admissions decisions is a hallmark of narrow tailoring, not evidence of unconstitutionality. The Top Ten Percent Plan had more of an impact on Fisher’s chances of admission. The Court noted the University’s continuing obligation to satisfy the strict scrutiny burden by periodically reassessing the program and by tailoring it to ensure that race plays no greater role than necessary to meet its compelling interests. Baquerizo v. Garden Grove USD
Student and Guardian seek reimbursement from the district for the cost of Student's private education, claiming that the district failed to comply with the procedural requirements of the Individuals with Disabilities Education Act, 20 U.S.C. 1400–1491o (IDEA), and thus failed to provide a free appropriate public education (FAPE) in the least restrictive environment (LRE) for Student. The district court affirmed the ALJ's denial of reimbursement. In regard to the June 2009 individualized education program (IEP), the court agreed with the lower courts that any procedural failure on the part of the district was caused by Guardian, and that, in any event, the Jordon Intermediate School placement was a FAPE. In regard to the June 2011 IEP, the court concluded that the IDEA does not require the school district to conduct all assessments possible. In this case, the district court did not violate the IDEA by failing to assess Student for anxiety and failing to determine the baseline for Student's speech and language goals. Finally, the Buena Park placement offer was a FAPE in the LRE for Student. Accordingly, the court affirmed the judgment. View "Baquerizo v. Garden Grove USD" on Justia Law
Morgan v. Sanford Brown Institute
In May 2013, plaintiffs Annemarie Morgan and Tiffany Dever filed suit against defendants Sanford Brown Institute, its parent company, Career Education Corporation, and Sanford Brown's chief executive officer, admission and financial aid officers, and clinical director. Sanford Brown was a private, for-profit educational institution with a campus in Trevose, Pennsylvania, that offered medical-related training programs. In the complaint, plaintiffs claimed that defendants misrepresented the value of the school's ultrasound technician program and the quality of its instructors, instructed students on outdated equipment and with inadequate teaching materials, provided insufficient career-service counseling, and conveyed inaccurate information about Sanford Brown's accreditation status. The complaint further alleged that Sanford Brown employed high-pressure and deceptive business tactics that resulted in plaintiffs financing their education with high-interest loans, passing up the study of ultrasound at a reputable college, and losing career advancement opportunities. The Sanford Brown enrollment agreement included payment terms for tuition and fees, disclaimers, and an arbitration provision. Without answering the complaint, defendants filed a motion to compel arbitration and to dismiss plaintiffs' claims. The Appellate Division found the parties clearly and unmistakably agreed an arbitrator would determine issues of arbitrability and that plaintiffs failed to specifically attack the delegation clause. The panel therefore determined that arbitrability [was] for the arbitrator to decide. The Supreme Court reversed, finding that the Appellate Division and trial court did not have the benefit of "Atalese v. U.S. Legal Servs. Grp.," (219 N.J. 430, 436 (2014), cert. denied, __ U.S. __, 135 S. Ct. 2804, 192 L. Ed.2d 847 (2015)) at the time they rendered their decisions. The New Jersey Court held in "Atalese" that an arbitration provision in a consumer contract that fails to explain in some minimal way that arbitration is a substitute for a consumer s right to pursue relief in a court of law was unenforceable. Binno v. Am. Bar Ass’n
Binno, a legally blind individual, unsuccessfully applied for admission to law schools. He then filed suit against the American Bar Association (ABA), under the Americans with Disabilities Act (ADA), claiming that his lack of success was due to a discriminatory admissions test “mandated” by the ABA. Thar examination, the Law School Admissions Test (LSAT) is used by nearly all U.S. law schools. Binno claimed that the LSAT's questions have a discriminatory effect on the blind and visually impaired because a quarter of those questions “require spatial reasoning and visual diagramming for successful completion.” The Sixth Circuit affirmed dismissal of the complaint, concluding that Binno does not have standing to sue the ABA because his injury was not caused by the ABA and because it is unlikely that his injury would be redressed by a favorable decision against the ABA. The LSAT is written, administered, and scored by the Law School Admission Council (LSAC), which is not part of the ABA. The LSAC provides ADA accommodations (42 U.S.C. 12189) for persons with disabilities who wish to take the LSAT. United Educators of San Francisco. v. Cal. Unemp. Ins. Appeals Bd.
In 2010-2011, the San Francisco Unified School District employed 11 substitute teachers who worked on an as-needed basis and 15 paraprofessional classified employees. Each of the 26 employees received a letter during the spring of the 2010-2011 school year advising that they had a reasonable assurance of employment for the following 2011-2012 school year. The 26 sought unemployment benefits for the period between the last date of the regular session of the 2010-2011 school year, May 27, 2011, and the first day of instruction for the 2011-2012 school year, August 15, 2011. The Employment Development Department denied benefits. The California Unemployment Insurance Appeals Board reversed. The trial court and court of appeals ruled in favor of the District: “in effect what the claimants ... are requesting is … a full year‘s income … they have agreed to work and be paid for only 41 weeks of each year. … school employees can plan for those periods of unemployment and thus are not experiencing the suffering from unanticipated layoffs that the employment-security law was intended to alleviate.” View "United Educators of San Francisco. v. Ringel-Williams v. W.V. Consol. Pub. Retirement Bd.
Petitioner has been employed by the Raleigh County Board of Education as a physical therapist since 1987. Her initial “Teacher’s Probationary Contract of Employment” provided that she would be paid an annual salary “for an annual employment term of 120 days.” In 1989, petitioner executed a “Continuing Contract of Employment,” which likewise provided that she was to be employed “for an employment term of 120 days.” She requested enrollment in the Teachers’ Retirement System (TRS). Contributions on petitioner’s behalf were made to TRS continuously from 1987 through 1991, when she enrolled in the newly-created Teachers’ Defined Contribution System and froze her TRS contributions. In 1999, she transferred her TRS funds and service credit into TDC. In 2008, petitioner transferred back to the TRS. The Board ascertained that petitioner was ineligible to participate in either plan because she was only working 120 days a year and indicated that the money contributed would be returned to her and her employer. Petitioner testified that she believed that those working less than 200 days were not ineligible, but would merely receive fractional service credit for the year. The hearing examiner determined that West Virginia Code 18-7A-3 requires a 200-day contract before one may participate in TRS, but that there was no such 200-day requirement to participate in TDC. The circuit court affirmed. The Supreme Court of Appeals affirmed, stating that it was “sympathetic," but could not confer statutory eligibility where none exists. View "Ringel-Williams v. W.V. Adams v. Pa. Higher Educ. Assistance Agency
Adams dropped out of school in the 11th grade, moved to West Virginia, and receives social security disability on the basis of severe hypertension, migraine headaches, and mild mental retardation with marginal illiteracy. In 2007, Adams began receiving calls from a collection agency regarding a $2,500 guaranteed student loan procured in her name in 1986, for the purpose of attending school in Florida. Adams denied entering into the loan agreement, executing an application or promissory note, or attending school, but, nonetheless entered into a “rehabilitation agreement,” and made about 30 payments of $86.00/month to remove the “default” status of the loan, which was then owned by the Department of Education as a federally guaranteed Stafford Loan. She claims the agency threatened to take her social security if she did not make payments. In 2010, she again disavowed the loan, claiming identity theft. An investigation was launched. Adams eventually agreed to assume responsibility again, but, in 2011, asserted that she was entitled to discharge because she was disabled. She submitted her social security award decision, but failed to produce a required physician’s report. She retained counsel, but the agency continued written and telephone contact. The circuit court entered summary judgment for the agency, holding that the debt collection activity is required by Federal Family Education Loan Program regulations promulgated under the Higher Education Act of 1965. The Supreme Court of Appeals of West Virginia affirmed, finding her state Consumer Credit and Protection Act claim preempted by federal law. View "Adams v. Pa. Higher Educ. Brown v. Chicago Bd. of Educ.
The Board of Education has a written policy that forbids teachers from using racial epithets in front of students, no matter the purpose. Brown, a Chicago sixth grade teacher, caught students passing a note in class. The note contained music lyrics with the offensive word “nigger.” Brown used the episode as an opportunity to conduct an apparently well‐intentioned discussion of why such words must not be used. The school principal happened to observe the lesson. Brown was suspended and brought suit under 42 U.S.C. 1983. Two of his theories were rejected on summary judgment: that his suspension violated his First Amendment rights, and that the school’s policy was so vague that his suspension violated the substantive due process component of the Fourteenth Amendment. The Seventh Circuit affirmed, stating “not everything that is undesirable, annoying, or even harmful amounts to a violation of the law, much less a constitutional problem.” Public‐employee speech is subject to a special set of First Amendment rules. Brown himself emphasized that he was speaking as a teacher, an employee, not as a citizen, so his suspension did not implicate his First Amendment rights. Brown’s surprise at being disciplined, along with a few episodes of non‐enforcement, do not support a substantive due process claim. View "Brown v. Chicago Bd. of Educ." on Justia Law
