Lexington Public Schools v. K.S.
The Supreme Judicial Court affirmed the order of the juvenile court judge denying a child's motion to dismiss a petition filed under Mass. Gen. Laws ch. 119, 39E by an assistant school principal, holding that the assistant principle did not engage in the unauthorized practice of law by filing and pursuing the petition.In the petition, the assistant principle asserted that the child required assistance because the child had been habitually truant from school. The child moved to dismiss the petition on the ground that the assistant principle, a nonattorney, was engaging in the unauthorized practice of law. The trial judge denied the motion. The Supreme Judicial Court affirmed, holding that the assistant principle did not engage in the unauthorized practice of law under the circumstances of this case. View "Lexington Public Schools v. Boyd, et al. v. Vermont
In October 2017, plaintiffs Sadie Boyd (a student at Twin Valley Middle High School in Whitingham, Vermont) Madeleine Klein (a resident and property owner in Whitingham), and the Town of Whitingham filed a complaint for declaratory and injunctive relief against defendant State of Vermont, arguing that the education funding and property taxation system set forth in 16 V.S.A. ch. 133 and 32 V.S.A. ch. 135 violated the Education Clause, the Proportional Contribution Clause, and the Common Benefits Clause of the Vermont Constitution. They claimed that the system was unconstitutional because it deprived plaintiff Boyd of an equal educational opportunity, required plaintiff Klein to contribute disproportionately to education funding, and compelled the Town to collect an unconstitutional tax. The civil division granted the State’s motion for summary judgment, concluding that plaintiffs failed to demonstrate the alleged inequities were caused by the statutes in question or that the education property taxation system lacked a rational basis. Riley’s American Heritage Farms v. Elsasser
Riley’s Farm provides historical reenactments and hosts apple picking. In 2001-2017, schools within the District took field trips to Riley’s. In 2018, Riley used his personal Twitter account to comment on controversial topics. Parents complained; a local newspaper published an article about Riley and his postings. The District severed the business relationship. In a 42 U.S.C. 1983 suit alleging retaliation for protected speech, the district court granted the District defendants summary judgment.The Ninth Circuit reversed as to injunctive relief but affirmed as to damages. Riley made a prima facie case of retaliation; he engaged in expressive conduct, some of the District defendants took an adverse action that caused Riley to lose a valuable government benefit, and those defendants were motivated by Riley’s expressive conduct. There was sufficient evidence that Board members had the requisite mental state to be liable for damages. The defendants failed to establish that the District’s asserted interests in preventing disruption to their operations and curricular design because of parental complaints outweighed Riley’s free speech interests. Even assuming that the selection of a field trip venue was protected government speech, the pedagogical concerns underlying the government-speech doctrine did not apply because Riley was not speaking for the District. Nonetheless, the defendants were entitled to qualified immunity on the damages claim. There was no case directly on point that would have clearly established that the defendants’ reaction to parental complaints and media attention was unconstitutional. G W v. Ringwood Board of Education
The parents of M.W., a minor eligible for services under the Individuals with Disabilities Education Act (IDEA), filed a Petition for Due Process against the Board of Education. Before a scheduled hearing, the ALJ met with counsel, M.W.’s parent, and a Board representative. The terms of a purported settlement were read into the record. In a “Decision Approving Settlement,” the ALJ made specific findings and ordered, “that the parties comply with the settlement terms.” The parents later contacted the Board, repudiating the agreement, and moved the ALJ to “set aside the settlement.” They filed suit, seeking relief under the IDEA.The district court questioned whether the ALJ’s bare findings that the settlement was entered into voluntarily and resolved all disputes satisfied the IDEA's jurisdictional requirements, concluded that it lacked jurisdiction, citing IDEA provisions for the enforceability of settlement agreements (20 U.S.C. 1415(e), 1415(f)(1)(B)), and held that the ALJ’s decision was not based on “substantive grounds,” under 1415(f). The Third Circuit reversed. The entry of a “Decision Approving Settlement” in an IDEA dispute satisfies section 1415(I)'s jurisdictional prerequisite to an appeal of an administrative IDEA determination. If a prevailing party may enforce a settlement agreement embodied in an administrative consent order as an “aggrieved party” under 1415(i)(2), then a party seeking to challenge such an order as improperly entered must likewise be able to bring a challenge in federal court. Starbuck v. Williamsburg James City County School Board
Plaintiff filed suit under 42 U.S.C. 1983, alleging that his public high school suspended him in violation of the First, Fifth, and Fourteenth Amendments. Plaintiff's claims stemmed from the actions taken against him by school personnel after he engaged in a conversation with his classmates about the shooting at Marjory Stoneman Douglas Highschool. The district court held that plaintiff's suit was barred under Monell v. Department of Social Services, 436 U.S. 658 (1978), and dismissed the complaint for failure to state a claim on which relief could be granted.The Fourth Circuit concluded that the school board acted as the final policymaking authority in approving plaintiff's suspension, and thus Monell does not bar the suit. Furthermore, plaintiff's complaint plausibly alleges a First Amendment claim where the First Amendment does not permit schools to prohibit students from engaging in the factual, nonthreatening speech alleged here. In this case, plaintiff engaged in a factual conversation with his peers about a current event that is uniquely salient to the lives of American teenagers, a school shooting. The court stated that schools cannot silence such student speech on the basis that it communicates controversial or upsetting ideas. To do so would be incompatible with the very purpose of public education. However, the court concluded that the district court properly held that the complaint alleges no plausible Fifth or Fourteenth Amendment claim. Shaffer v. George Washington University
The Universities responded to the COVID-19 pandemic by transitioning from in-person to online learning and largely shutting down campus activities. Students and parents sued, claiming that the Universities violated contractual commitments when they transitioned to online educational activities and declined to refund any portion of their students’ tuition and fees or, in the alternative, that the transitions unjustly enriched the Universities.The D.C. Circuit affirmed the dismissal of conversion claims and claims that the Universities breached express contracts promising in-person educational instruction, activities, and services. They did not plausibly allege a possessory interest in a specific, identifiable fund of money. The cited materials cited do not support the express contract claims. Reversing in part, the court held that the complaints plausibly allege that the Universities breached implied-in-fact contracts for in-person education, on-campus activities, and services. The plaintiffs should be allowed to raise their alternative theory of unjust enrichment. The court also reinstated a claim under the D.C. Consumer Protection Procedures Act. The court acknowledged that the Universities will likely have compelling arguments to offer that the pandemic and resulting government shutdown orders discharged their duties to perform these alleged promises, which must be addressed by the district court. Wamer v. University of Toledo
UT instructor Tyger subjected Wamer, a UT student, to inappropriate touching, comments, and text messages and made inappropriate comments in class. Wamer contacted a UT faculty member; each submitted a complaint to UT’s Title IX Office. Wamer alleges that she was afraid of seeing Tyger on campus and of retribution and that UT stated it would pursue the investigation even if she did not come in for an interview. Three weeks later, UT closed its investigation, taking no action. About five months after the harassment began, a more senior faculty member reported Wamer’s allegations. UT then placed Tyger on paid leave and banned him from campus. Wamer alleges that Tyger then attempted to smear Wamer’s reputation. UT investigators found that Tyger had engaged in sexual misconduct.Wamer sued under Title IX, claiming that UT was deliberately indifferent to the initial reports of sexual harassment, which “unreasonably interfered with Wamer’s participation in and enjoyment of the benefits of UT’s educational programs and activities.” The district court dismissed, applying the elements of a deliberate-indifference claim used in cases of student-on-student harassment and finding Wamer did not allege that UT’s actions post-notice resulted in harassment or made her more vulnerable to further harassment.The Sixth Circuit reversed. A plaintiff can satisfy the causation requirement by showing that following the school’s unreasonable response, the plaintiff experienced an additional instance of harassment or that objectively reasonable fear of further harassment caused the plaintiff to take specific reasonable actions to avoid harassment, which deprived the plaintiff of educational opportunities available to other students. Tabb v. Board of Education of the Durham Public Schools
Plaintiff filed suit under Title VII of the Civil Rights Act of 1964 and 42 U.S.C. 1981, alleging that the school board discriminated against him on the basis of race in refusing to hire another teacher in the drama department to assist him with tech work in connection with his staging of student performances or, alternatively, in refusing to provide him with additional compensation for the tech work that he performs. Plaintiff also alleged that the school board discriminated against him on the basis of race when compensating him for his "extra-duty" work in connection with other events at the high school.The Fourth Circuit concluded that plaintiff failed to allege plausibly that the school board's failure to pay him a Theater Technical Director Supplement constituted race-based employment discrimination. While the court agreed that it was error for the district court to consult the School of the Arts' website in determining whether the complaint properly alleged that the School of the Arts was an appropriate comparator, the court concluded that the error was harmless. The court also concluded that no reasonable jury could have returned a verdict for plaintiff on his discrimination claim based on the denial of assistance. Finally, the court agreed with the district court that plaintiff did not provide a valid comparator for purposes of supporting this racial discrimination claim. Accordingly, the court affirmed the district court's dismissal of a portion of the complaint for failing to state a claim. In regard to the remaining claims, the court granted the school board's motion for summary judgment based on plaintiff's failure to present sufficient evidence to support his claims. View "Tabb v. Srouy v. San Diego Unified School District
Vanndrya Srouy graduated from Crawford High School (Crawford) in the San Diego Unified School District (the District). While a student at Crawford, he was a member of its varsity football team. After Srouy graduated, he found himself named as a co-defendant in a lawsuit filed by a football referee, John Herlich, who claimed to have been injured when Srouy blocked an opponent, who fell into Herlich, during a school football game. The District (as co-defendant) rejected Srouy’s tender of his defense in the Herlich lawsuit. Srouy then filed underlying lawsuit against the District, claiming the District violated a mandatory duty to defend him in the Herlich lawsuit. Srouy alleged this duty arose under the free school guarantee and the equal protection clause of the California Constitution; title 5, section 350 of the California Code of Regulations; and/or Education Code section 44808. The trial court granted the District’s demurrer without leave to amend and dismissed Srouy’s operative complaint. "Although Srouy’s plight evokes our sympathy," the Court of Appeals found its ability to respond was "constrained by the law, and the allegations of this case do not afford a judicial solution. We leave it to the Legislature to determine whether the needs of student athletes in Srouy’s position are sufficiently addressed by current law, and if not, to craft an appropriate solution." G.D. v. Swampscott Public Schools
The First Circuit affirmed the decision of the district court granting judgment to Defendants and denying a declaration requested by Plaintiffs that the Massachusetts Bureau of Special Education Appeals (BSEA) erred in determining that Swampscott Public Schools had provided their daughter, G.D., with a free appropriate public school education as required under the Individuals with Disabilities Education Act (IDEA), 20 U.S.C. §§ 1400 et seq., holding that there was no error.Plaintiffs sought a determination from the BSEA that G.D.'s Individualized Education Program (IEP) was not reasonably calculated to provide her with a free appropriate public education (FAPE) and further sought reimbursement from Swampscott Public Schools associated with Plaintiffs' unilateral placement of G.D. at a nearby private school. After the BSEA denied the claims Plaintiffs filed suit against the school district and the BSEA. The district court determined that G.D.'s IEP was reasonably calculated to provide her with a FAPE and entered judgment for Defendants. The First Circuit affirmed, holding that Plaintiffs were not entitled to relief as to any of their allegations of error. View "G.D. v. Swampscott Public Schools" on Justia Law
